1. Introduction
The following order terms apply in addition to the General Terms of Use (www.m-unity.de) for placing orders for goods by the user outside the business premises of the providers, for ordering goods, and for delivery to the specified addresses of customers. They also form part of the contract between the provider and the customer.
2. Orders and Deliveries
- The delivery of goods is restricted to the delivery area specified by the provider. Any existing delivery restrictions will be clearly communicated to the customer no later than the start of the ordering process.
- In the case of goods delivery, the time required for delivery depends on local circumstances (e.g., order volume, delivery distance, etc.).
3. Provision and Conclusion of Contract
- Listing goods on the website does not constitute a binding offer by the provider but merely an invitation for the customer to make an offer.
- A binding offer aimed at concluding a purchase agreement is made when the customer submits the order by confirming it, covering all items assigned to the customer’s individual virtual shopping cart.
- Before submitting the binding order, the customer has the opportunity to review and correct all entered data. The customer is obliged to provide truthful, diligent, and complete information regarding residential address, payment details, phone number, and email address to ensure proper processing of the order.
- The providers will promptly send the customer confirmation of receipt of the offer via email or another form of notification after dispatching the goods for delivery.
- Acceptance of the contract offer occurs when the provider declares acceptance to the customer or hands over, provides, or ships the goods.
- The provider may refuse acceptance of the contract offer in individual cases (e.g., suspected prank orders, misuse of EC/credit cards, address outside the delivery area) without giving reasons.
4. Pricing and Shipping Costs, Payment
- The customer pays the purchase price to the provider. Orders can be paid for online by the customer.
- All price information includes gross prices (including statutory VAT). Any additional costs for payment and shipping will be clearly and prominently communicated to the customer before they place their order.
- The provider determines which payment methods are available for processing payments. These payment methods will be clearly communicated to the customer no later than the start of the ordering process and made available for selection. The payment method is bindingly chosen during the ordering process by the customer.
5. Statutory Right of Withdrawal, Exclusions
- Customers who qualify as consumers under Section 13 of the German Civil Code (BGB) are entitled to a statutory right of withdrawal under legally defined conditions. Details are specified in the withdrawal policy.
- Any existing statutory right of withdrawal expires if the provider has fully performed the services requested by the customer and began execution only after the customer provided express consent that they lose the right of withdrawal upon full performance of the contract by the provider, provided the consent was delivered on a durable medium.
